These terms govern your use of the Khabir service. By using the service you agree to these terms; if you do not agree, please do not use the service.

1. The service

Khabir is a software service that lets you upload knowledge content and install a chat widget on your website that answers your visitors based on that content. We reserve the right to develop the service and modify its features from time to time.

2. Accounts and eligibility

You must be legally able to enter into a contract and provide accurate information when registering. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.

3. Plans and billing

• We offer a free plan and paid plans as published on our pricing page. Prices may change with reasonable prior notice.
• A “conversation” is counted as described on our site: a session where a visitor sends at least one message, including up to 20 messages back and forth, counted once. Your quota resets on the 1st of each month, and unused conversations do not roll over.
• Paid subscriptions renew automatically at the start of each billing cycle unless you cancel before renewal.
• Payments are non-refundable except where required by law. When you reach your plan limit, the assistant pauses politely with no automatic extra charges.

4. Acceptable use

You agree not to use the service for any of the following:

• Any unlawful purpose or in violation of others' rights.
• Uploading content you do not have rights to, or content that is harmful, misleading, or privacy-infringing.
• Attempting to hack, disrupt, circumvent usage limits, or reverse-engineer the service.
• Reselling the service or misusing the AI models in breach of their providers' terms.

5. Your content and knowledge base

You retain ownership of all content you upload. You grant us a limited license to use and process that content (including sending it to AI providers) solely to operate the service for you. You represent that you hold the necessary rights to this content, that it does not violate any law or third-party right, and that you have obtained any consents required for personal data it contains.

6. Nature of AI answers

Khabir generates its answers automatically based on the content you provide and third-party AI models. Answers may be inaccurate or incomplete and do not constitute professional advice (legal, medical, financial, or otherwise). You are responsible for reviewing the content you provide and the resulting answers, and for any decisions made based on them.

7. Intellectual property

The service, its software, design, and the Khabir trademark remain our property. You acquire no rights in them other than the right to use granted under these terms. The content you upload remains yours.

8. Third-party services

The service relies on third-party providers (such as AI model, payment, and hosting providers). Your use of the service may also be subject to those providers' terms, and we are not responsible for outages or changes in their services that are beyond our control.

9. Disclaimer of warranties

The service is provided “as is” and “as available”, without any warranties, express or implied, including fitness for a particular purpose, uninterrupted operation, or freedom from errors. We do not warrant that answers will be accurate or suitable for your purpose.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, consequential, or incidental damages, or loss of profits or data. Our total liability to you, whatever the cause, will not exceed the amount you paid us in the twelve months preceding the event giving rise to the liability.

11. Indemnification

You agree to indemnify and defend us against any claims or losses arising from your breach of these terms, the content you upload, or your use of the service in violation of the law or others' rights.

12. Suspension and termination

You may terminate your account at any time. We may suspend or terminate the service if you breach these terms or if your use poses a risk to the service or others. On termination, your right to use the service ends, and your data is handled per our Privacy Policy.

13. Changes

We may amend these terms from time to time. We will post the updated version here with a revised “Last updated” date, and your continued use of the service after that constitutes acceptance of the changes.

14. Governing law

These terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, and the competent courts of Gotha, Germany, have jurisdiction over any dispute arising from them, without prejudice to any mandatory rights granted to you by the law of your country of residence.
